About DUI Charges in Illinois

If you are over the age of 21, you can be charged with DUI in the state of Illinois if you are found to be operating a vehicle with a blood alcohol content of 0.08 percent or more. If you are under the age of 21, you can be charged with DUI if any alcohol is found in your blood.

The penalties for a DUI conviction vary based on your criminal history and other factors. In general, possible penalties for conviction in Illinois are as follows:

  • First offense. – For your first DUI conviction, your sentence may include up to one year in jail, a fine of up to $2,500, a license suspension of at least one year and/or installation of an ignition interlock device.
  • Second offense.- For your second DUI conviction, your sentence may include up to one year in jail, a fine of up to $2,500, a license suspension of at least five years and/or installation of an ignition interlock device.
  • Third offense. – For your third DUI conviction, your sentence may include up to seven years in jail, a fine of up to $2,500, a license suspension of at least ten years and/or installation of an ignition interlock device.
